FERC-577 identifies information collection activities relating to Parts 2, 157, 284, and 380 of the Commission's regulations implementing the National Environmental Policy Act (NEPA) and information collections relating to landowner notifications.
Section 102 (2)(c) of National Environmental Policy Act of 1969 (Pub.L 91-190) (42 U.S.C. 4321) requires that all Federal agencies consider the environmental impact of its decisions regarding those activities that are major federal actions significantly affecting the quality of the human environment; produce a detailed statement on the environmental impact of the proposed actions that addresses any adverse environmental effects which cannot be avoided; and produce alternatives to the proposed action. To carry this out, under Parts 153.8, 157.14(a)(7), 157.206(b), and 380.12-.14380.12 of its regulations, the Commission requires applicants seeking authorization to construct and abandon facilities to provide a detailed environmental report alongenvironmental related information with their application, addressing resource areas affected by the proposed action. The environmental report consists of at least twelve separate reports, each addressing a particular resource area. The remaining component of FERC-577 identifies theUnder Parts 2.55(c), 157.6(d), 157.203(d), 284.11(b), and 380.15 of its regulations, the Commission established that Commissionâs regulations which require that a natural gas company must notify affected landowners of planned activities at least five days prior to coming onto their property for certain activities. The notifications include: (1) a brief description of the activity to be conducted or facilities to be constructed/replaced and the effects that the activities are expected to have on the landownerâs property; (2) the name and phone number of the company representative that is knowledgeable about the project; and (3) a description of the Commissionâs Dispute Resolution Service Helpline, as explained in Section 1b.21(g) of the Commissionâs regulations, and the Dispute Resolution Service Helpline number. The Commission defines âaffected landownersâ as owners of property interests, as noted in the most recent tax notice, whose property is directly affected (i.e. crossed or used) by the proposed activity, including all rights-of-way, facility sites, access roads, pipe and contractor yards, and temporary workspaces.

In this Notice of Proposed Rulemaking (NOPR), the Commission proposes to amend its regulations to establish procedures for authorizing activities at liquefied natural gas (LNG) plants without the need for operators to file case-specific applications or for the Commission to issue case-specific orders under sections 3 or 7 of the Natural Gas Act (NGA).1 This NOPR includes proposed revisions to Parts 2, 153, and 375 of the Commissionâs regulations. The proposal includes the creation of an LNG blanket program allowing the automatic or prior notice authorization for certain activities. This proposed rule would reduce the reporting burden because it expands exemptions to submitting a full application, as a result, there would be more entities that would not need to submit full applications and they would either submit abbreviated fillings or only report activities on an annual report.
