Notice of Arrival of Pesticides and Devices under section 17(c) of FIFRA (Renewal)

Under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the Environmental Protection Agency (EPA) regulates the importation of pesticides and pesticide devices into the United States. FIFRAs definition of pesticides is broad and includes any substance or mixture of substances intended for preventing, destroying, repelling, or mitigating any pest (e.g., rodenticides, insecticides, herbicides, fungicides, and antimicrobials) and certain other substances such as plant growth regulators and any nitrogen stabilizers; the definition also includes substances imported for pesticide research and development purposes. FIFRAs definition of pesticide devices include any instrument or contrivance (other than a firearm) which is intended for trapping, destroying, repelling, or mitigating any pest or any other form of plant or animal life. FIFRA section 17(c) governs the importation process for pesticides and pesticide devices into the U.S., while FIFRA 17(e) authorizes the U.S. Department of the Treasury, in consultation with the EPA, to promulgate regulations implementing pesticide and device trade enforcement. This authority was delegated to the Department of Homeland Security's U.S. Customs and Border Protection (CBP) in 2003. CBP regulations, developed in concert with the EPA, give the EPA specific roles in the importation process.
