This
recordkeeping requirement is approved subject to the two following
conditions: 1. Change the language of FHWA's proposed BMC-82 (1981)
to that in the attached approved form. This modified language is
necessary to broaden the use of this new surety bond form to ICC
certificated and permitted motor carriers of property affected by
Sections 29 and 30 of the Motor Carrier Act of 1980. 2. Prior to
resubmitting this recordkeeping requirement for approval by June,
1983, FHWA is required to solicit public comments on the language,
use, and compliance of this surety bond form (BMC-82) from both
motor carriers of property and surety bond companies to determine
if any additional changes are necessary. This public solicitation
should include comments from both large and small motor carriers of
property and surety bond companies. A summary of the method and
substance of the public comments received should be included in
paragraph 5 of the supporting statement submitted with the June
1983 approval request.
