We have approved
continued use of these recordkeeping requirements for two
additional months to allow the agency additional time to consider
scheduling a regulatory review of these provisions as we directed
in our conditions of clearance dated August 10, 1987. The agency
has not yet addressed the concerns that we raised with regard to
these paperwork requirements. It appears, for example, that a
certification of compliance, as defined in 5 CFR 1320.7(k)(1),
would fulfill the agency's mission while imposing less burden.

MINE RESCUE STATIONS BE INSPECTED AND TESTED ONCE EACH MONTH TO
ENSURE THAT IT WOULD BE OPERABLE IN CASE OF AN EMERGENCY. RECORDS
OF THE RESULTS OF THE INSPECTIONS AND TESTS ARE REQUIRED TO BE
MAINTAINED AT THE MINE RESCUE STATIONS.
