Pursuant to 5 CFR 1320 and the PRA, OMB cannot approve this collection of information at this time. OMB remains concerned that the information collected may not impose the least amount of burden necessary to carry out agency objectives. Specifically, 1) Why is it necessary for some small boilers to have continuous emissions monitoring systems when it is not necessary for other boiler 2) What purpose does it serve for residual oil units to analyse the first shipment of oil for sulfur content and no other? How will this requirement aid in the enforcement of the rule? 3) How could a distillate oil unit certify that all oil cumbusted in the unit complied with the ASTM specifications for distillate oil? A very burdensome continuous testing regime would seem the only means to comply with this requirement. EPA should address these issues when it resubmits this collection for review at the time it finalizes the small boiler regulation.
