Abstract: SECTION 302(B) OF FLPMA REQUIRES THAT IN MANAGEMENT OF PUBLIC LANDS, ACTION TO PREVENT UNNECESSARY AND UNDUE DEGRADATION WILL BE UNDERTAKEN 43 CFR 3809 REGULATES SURFACE DISTURBANCE AND ENSURES RECLAMATION ON MINING CLAIMS AND SITES LOCATED UNDER THE MINING LAWS ON LANDS ADMINISTERED BY THE BLM BY REQUIRING A MINE OPERATOR TO FILE A NOTICE PLAN OF OPERATIONS. THE RESPONDENT MAY BE AN INDIVIDUAL OR A MULTI-NATIONAL CORPORATION.
