Terms of Clearance: This ICR is not approved. The Paperwork Reduction Act regulations require that the collection of information is the least burdensome necessary for the proper performance of the agency's functions to comp with legal requirements and achieve program objectives (5 CFR 1320.4(b EPA has not adequately demonstrated that its preferred approach, a minimum requirement of annual sampling for facilities (except for oi and gas exploration or production operations and inactive mining operations) is less burdensome than the risk-based monitoring approaches described in Option 4 and Option 5 or that risk-based monitoring does not comply with legal requirements or program objectives.
