proper performance of the agency's functions to comp with legal
requirements and achieve program objectives (5 CFR 1320.4(b EPA has
not adequately demonstrated that its preferred approach, a minimum
requirement of annual sampling for facilities (except for oi and
gas exploration or production operations and inactive mining
operations) is less burdensome than the risk-based monitoring
approaches described in Option 4 and Option 5 or that risk-based
monitoring does not comply with legal requirements or program
