We have approved
the current change reducing the paperwork burden, however, the
terms of clearance concerning the underlying rule and previous
proposed changes regarding Form 1412 remains subject to the
following comments of the Office of Federal Procurement Policy
pursuan to 44 USC 3504(h). Agencies may continue to collect
information under the existing regulation. COMMENTS: The proposed
rule does not sufficiently authorize and encourage contracting
officers to rely on competitive acquisition in the place of
burdensome cost or sales data submissions. The rule should more
strongly discourage contracting officers from requiring the
submission of cost or sales data when pric analysis based on
verifiable competitive results is possible. The rul should state
clearly that Cost Accounting Standards and Contract Cost Principles
apply only to contractors that submit cost or pricing data. These
concerns need to be addressed before issuance of the final rule as
to ensure that the information collected has practical utility and
does not exceed the minimum necessary to protect the government's
interests. OFPP will work with the FAR staff to resolve these
concern
