counsel's defense of the question about, "...arrested or charged
with any violation of Federal or State law..." (instructions 3.b.)
as being indicative of the character of the applicant. Further,
counsel argues that applicants have the opportunity to explain the
circumstances of a arrest or charge. OMB notes that it has not made
an independent assessment of the use of information about arrests
and charges. . The Paperwork Reduction Act notice should be
corrected to direct comments to both BATF and the Paperwork
Reduction Project.
