This ICR for
third party notification under EPCRA 302, 303, and 304 is approved
until 1/97. EPA shall seek public comments on its burden estimates,
methods and assumptions for calculating burden and opportunities
for reducing unnecessary burdens. In particular, EPA should verify
that 10% of facilities would con- act LEPCs about changes on a
yearly basis (page 8) and 5% actual- ly provide additional
information. In addition, EPA should con- firm what protion of a
release report is routinely provided as part of other (e.g. police)
reports and thus should be excluded from the burden estimate as
customary and usual. EPA shall adhere to OMB guidance in
calculating third party notification burdens when this ICR is
renewed. Finally, EPA shall evaluate the number of 911
notifications versus LEPC notifications to determine the number of
respondents in each category.

Section 302 of the Emergency Planning
and Community Right-to- Know Act (EPCRA) requires facilities that
the extremely hazardous substances above the threshold planning
quantity to notify and coordinate with state and local prepredness
entities. Secion 304 requires facilities to immediately notify
state and local entities in the event of accident releases of
hazardous chemicals. Written follow-up notice is also
required.
