This OMB control
number applies to all of the information collection requirements
added by the FCC's implementation of Section 302 of the
Telecommunications Act of 1996. Specific changes and additions were
made to Part 76 of the Commissions rules, including adding Subpart
S. This collection also includes a new form, FCC Form 1275, Open
Video Certification of Compliance which can be filed in electronic
format. As an ongoing FCC regulatory proceeding, the Commission is
strongly encouraged to rely on existing mechanisms for collecting
information and exercising regulatory oversight. The FCC has
permission to not use an expiration date on the FCC 1275 if a date
of issue is used.

In this proceeding, the Commission has
developed a record to determine what rules, if any, need to be
adopted to effectuate the requirements of section 302 of the
Telecommunications Act of 1996. Pursuant to comments received in
the initial rulemaking, the Commission now adopts a Second Report
and Order to begin implementation of the regulatory framework to
govern OVS.
On behalf of this Federal agency, I certify that
