Under sections 6 and 19 of the Securities Exchange Act of 1934, a registered or exempted exchange must be organized and must have the capacity to carry out the purposes of the Act and must have rules designed to protect investors and the public interest. Rule 6a-3, originally adopted in 1950, is designed to enable the Commission to carry out its oversight functions and to assure that such exchanges continue to be in compliance with the Act. Rule 6a-3 includes other forms of exchange organization, simplifies the existing rule language, and provides an additional means of compliance for certain reporting requirements.
