Prior to
issuance of the final rule, the agency should reexamine its
estimate of one hour per response in light of the amount of
information necessary to judge the acceptability of a particular
gear.

After publication of a proposed and
final rule that establishes a list of gear and fisheries by fishery
management council and establishes criteria to describe what
"different gear" are, fishermen would have to request that a
specific fishery management council allow a new gear type or
fishery within its jurisdiction and wait a 90-day period before
employing that gear or participating in that fishery. A given
council could determine that the gear or fishing activity is
prohibited or a new gear or fishery should be allowed within a
given council's jurisdiction, or is a potential new gear or
fishery.
