The FCC has
permission to delete the expiration date if a date of issuance is
used. OMB will not approve this collection again if there continues
to be no provision for electronic filing. Additionally, OMB is
disappointed that the FCC did not address deleting the annual
filing or certification requirement for cases where ownership
circumstances remain unchanged in the Commission's MM Docket Nos.
98-43 and 94-149. Finally, the FCC shall revise the FCC-323
Question 11 and Item 8 in the instructions to reflect the Revisions
to the Standards for the Classification of Federal Data on Race and
Ethnicity; Notices, Section entitled Standards for Maintaining,
Collecting, and Presenting Federal Data on Race and Ethnicity as
promulgated in Federal Register dated October 30, 1997 Vol. 62 No.
210, page 58781. Specifically, the FCC shall use the two-question
format and inform respondents that they may chose more than one
race.

Each licensee is required to file
FCC-323 every other year on the anniversary date that its renewal
application is required to be filed. Each permittee is required to
file FCC-323 within 30 days of the date of grant by the FCC of an
application for original construction permit, transfer of control,
or assignment of license. The data is used by FCC staff to
determine whether the licensee/permittee is abiding by the multiple
ownership requirements as set down by the Commission's rules and is
in compliance with the Communications Act of 1934, as
amended.
