The FCC has
adopted a recordkeeping requirement for entities that choose to use
the FCC's proposed contour measurement techniques as a means of
determining whether a home is eligible to receive local television
broadcaster programming from satellites. OMB merged this collection
which was proposed as a standalone collection with the collection
that was approved by OMB covering the NPRM. OMB believes that
because the FCC does not prescribe use of measurements or models to
make the actual determination or eligiblity, these are not covered
by the PRA. The FCC does have a requirement that entities that do
take these measurements shall retain the results to assist in
adjudicating future claims which is covered under the PRA.

The Commission has released a Report
and Order in the Matter of Satellite Delivery of Network Signals to
Unserved Households for Purposes of the Satellite Home Viewer Act
and Definition and Measurement of Signals of Grade B Intensity
("Report and Order"). In the Report and Order, the Commission
addresses its methods for determining whether a consumer is
receiving an adequate television network signal under the 1988
Satellite Home Viewer Act.
