Abstract: Plan documents are required to be amended to eliminate provisions that do not comply with the HIPAA nondiscrimination statute and regulation. In addition self-funded non-Federal governmental plans are required to give individuals who were previously discriminated against an opportunity to enroll, including notice of an opportunity to enroll.
