Abstract: Pursuant to Section 5g of the Commodity Exchange Act, as amended, the Commission is prescribing privacy rules under Title V of the Gramm-Leach-Bliley Act. Title V requires financial institutions to provide their customers with a notice of their privacy policies, and prohibits such institutions from disclosing nonpublic personal information about a consumer unless the consumer has not opted out of the disclosure. The likely respondents are futures commission merchants, commodity trading advisors, commodity pool operators and introducing brokers.
