Proposed Rule 41.42 would require firms that are registered with both the SEC as a broker or dealer and with the CFTC as a futures commission merchant to make choices and disclosures as to how customer transactions in security futures products will be treated. The proposed rule is specifically designed to avoid application of duplicative or conflicting regulations to such dually registered firms.
