This information
collection request is approved as revised by CMS in its 11/12/02
e-mail memo. The package as originally submitted contained
revisions proposed in a May 09, 2002 NPRM. Because this rulemaking
has not yet been finalized, OMB is not approving these proposals at
this time. CMS must resubmit this package with any revisions that
are incorporated into the final EMTALA regulation once it has been
developed. Further, a reassessment of the burden of this collection
will be made at that time. CMS is encouraged to continue to explore
ways of reducing reporting & recordkeeping requirements on
providers while working to reduce incidences of "hospital
dumping."

BPD-393 and HCFA-1005-FC contain
information collection requirements for hospitals that seek to
prevent them from inappropriately transferring individuals with
emergency medical conditions, as mandated by Congress. CMS uses
this information to help assure compliance with this mandate. This
information is not contained elsewhere in regulations.
