In accordance
with 5 CFR 1320.11, OMB disapproves the information collections in
the final rule RIN 2060-AG13, published June 27, 2003. OMB finds
that the information required to be submitted under this rule lacks
practical utility and does not fulfill the need identified for this
information. OMB is willing to consider future rulemaking and
submissions that propose alternative collections to meet this need.
In accordance with 5 CFR 1320.11(k), the agency must publish a
notice in the Federal Register informing the public that OMB has
not approved these provisions in the CFR. The agency may wish to
incorporate this notice into an Advance Notice of Proposed
Rulemaking or a Notice of Proposed Rulemaking to remove these
provisions from the CFR.
