(Form I-92)

A. Justification:

  1. This form is part of the manifest requirements of sections 231 and 251 of the I & N Act. The Form I-92 is used to collect passenger and crew information from commercial airlines upon arrival in the US at CBP ports of entry. It lists the airline, flight number, points of origin and destination, US citizen and alien passengers and crew.


  1. The Bureau of Economic Analysis and Travel and Tourism Administration, both Department of Commerce Agencies, have stated a continuing need for the data collected on this form. These agencies currently obtain their data from the Department of Transportation’s analysis of the I-92 forms. The information collected in the I-92 form is a necessary component for all of these agencies and is not available from any other source. The Form I-92 is used by CBP to verify passenger and crew counts against those provided through the Advanced Passenger Information System. The collected information is also used by other agencies to develop statistics and trends in domestic and international travel, trade, and tourism.


  1. The information on the Form I-92 is entered in a database and made available to government agencies. The I-92 is filled out on the plane and submitted to CBP upon arrival, so electronic submission is not appropriate.


  1. A search of the agency automated forms tracking system was accomplished and revealed no duplication. There is no similar data collected.


  1. This collection of information does not have an impact on small businesses or other small entities.


  1. The Bureau of Economic Analysis and Travel and Tourism Administration, and Department of Commerce Agencies have stated a continuing need for the data collected on this form. These agencies currently obtain their data from the Department of Transportation’s analysis of the I-92 forms. The unavailability of this information would hinder necessary practices and procedures.

  1. The special circumstances contained in Item 7 of the Supporting Statement are not applicable to this information collection.


8. Two Federal Register Notices were published on September 18, 2006 and on November 24, 2006. As of this submission, two comments have been received from the Department of Commerce. The Department of Commerce is not a respondent to the I-92, however, they use the data that CBP collects. One comment is from the Bureau of Economic Analysis, and one from the International Trade Administration. Both letters support CBP’s renewal of the Form I-92. However, the comments from the International Trade Administration go beyond the scope of the PRA in that they raise issues that they suspect that certain CBP ports may be under-reporting I-92 data


  1. The CBP does not provide payment or gifts to respondents in exchange for a benefit sought.


  1. There is no assurance of confidentiality.


  1. There are no questions of a sensitive nature.

Annual Burden Hours

The annual reporting burden is 129,600. This figure was derived by multiplying the number of respondents (720,000) x frequency of response (1) x 11 minutes per response (.18). This calculation is based on prior government experience with the program.


Public Cost

The estimated annual public cost is $1,296,000. This is based on the number of respondents 720,000 x 11 minutes (.18) per response x $10 (Average hourly rate).

  1. There are no capital or start-up costs associated with this information collection. Any cost burdens to respondents as a result of this information collection are identified in Item 14. There is no fee charge associated with the collection of this information.


14. Government Cost

The estimated cost to the Government is $1,792,800. This figure is calculated by using the estimated number of respondents 720,000 x 5 minutes (0.083) which is 59,760 hours. This is multiplied by an average hourly rate of $30.


  1. There has been no increase or decrease in the estimated burden hours previously reported for this information collection.

  1. This information collection will not be published for statistical purposes by CBP.


17. We will put the expiration date on the form when we receive a Notice of Action from OMB with the new date.


  1. CBP does not request an exception to the certification of this information collection.


B. No statistical methods were employed by CBP.
