The Form I-9 was developed to
facilitate compliance with Section 274A of the Immigration and
Nationality Act, as amended by the Immigration Reform and Control
Act of 1986, making employment of unauthorized aliens unlawful and
diminishing the flow of illegal workers in the United
States.
US Code:
8
USC 1324a Name of Law: Immigration and Nationality Act
There has been an increase of
333,000 burden hours due to an adjustment in the number of Form
I-9's being electronically stored. This can be attributed to an
error in a previous reporting document (Interim Regulation,
Electronic Signature and Storage of Form I-9, Employment
Eligibility Verification, June 15, 2006, at 71 FR 34510), that
listed electronic recorkeepers as 39,000,000 instead of
20,000,000.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
The following is a summary of the topics, regarding
the proposed collection of information, that the certification
covers:
(i) Why the information is being collected;
(ii) Use of information;
(iii) Burden estimate;
(iv) Nature of response (voluntary, required for a
benefit, or mandatory);
(v) Nature and extent of confidentiality; and
(vi) Need to display currently valid OMB control
number;
If you are unable to certify compliance with any of
these provisions, identify the item by leaving the box unchecked
and explain the reason in the Supporting Statement.
