The IFQ Program provides management
measures for the commercial fisheries that use fixed gear to
harvest sablefish and Pacific halibut. The IFQ Program limits
access to the Pacific halibut and sablefish, and crab fisheries to
those persons holding quota share in specific management areas.
Since the initial implementation of the IFQ Program, individuals
have submitted numerous petitions to NMFS and the North Pacific
Fisheries Council requesting the temporary transfer of IFQs for
medical reasons. These individuals sought medical transfers due to
the inability of IFQ holders to physically be aboard the vessel as
IFQs were fished. NMFS was previously unable to implement a medical
transfer program recommended by the Council due to legal
constraints. The approach provided in this action would resolve the
legal issues resulting from previous approaches.
