The NIGC is authorized by the IGRA to issue certificates of self-regulation to tribes for class II gaming operations. This information collection requirement is necessary to determine whether a tribe is self-regulating. In addition, those tribes who have received a certificate of self-regulation are required to submit an annual report to the NIGC to establish that the tribe has continuously met the criteria.
US Code:
25 USC 2701
Name of Law: Indian Gaming Regulatory Act
The NIGC over-estimated the number of tribes who would petition for a certificate of self-regulation and has adjusted its numbers accordingly.
