A. Justification


1. CBP Form-1303, Ship's Stores Declaration, is a form that was developed by the United Nations International Maritime Organization (IMO) in conjunction with the United States and other countries. The form was developed as a single international standard ship's stores declaration form to replace the different forms used by various countries for the entrance and clearance of vessels, pursuant to the provisions of section 432, Tariff Act of 1930, as amended, and Bureau of Customs and Border Protection (CBP) Regulations (19 CFR 4.7 and 4.7a(2)).


2. CBP Form-1303 is used by the importing carriers to declare ship's stores to be retained on board the vessel, such as sea stores, ship's stores, or bunker coal, or bunker oil in a format that can be readily audited and checked by CBP. CBP excludes most ship's stores from being placed under seal while the vessel is in port. If this information was not collected, CBP would lose control over the articles in the ship's stores.


3. CBP plans to automate this form through the Automated Commercial Environment (ACE) which is currently under development. It is planned that this form will be automated by 2012.


4. The information provided for each submission is unique and only provided on this form. Therefore, identical information will never be available elsewhere.


5. No additional consideration has been given to small businesses or other entities.


6. If the collection was collected less frequently CBP would lose control of inventory for ship's stores, sea stores, bunker coal, etc. Also, failure to collect the information will result in loss of control and compromise revenue collection.


7. This information collection is conducted in a manner consistent with the guidelines in

5 CFR 1320.5(c)(2).


8. Public comments were solicited through two Federal Register notices published on January 23, 2008 (Volume 73, Page 3983) and on March 25, 2008 (Volume 73, Page 15768). As of this submission no comments have been received.


9. There is no offer of a monetary or material value associated with this information collection.

10. There are no assurances of confidentiality because the information collected is not of a confidential nature.


11. There are no questions of a personal or sensitive nature.


12. Estimated Annualized Burden on the Public. The annual burden for this information collection is estimated to be 26,000 hours. This is based on 8,000 respondents averaging 13 responses for a total of 104,000 responses each response requires .250 hours (15 minutes) to complete for a total of 26,000 hours.

Estimated Annualized Cost to the Public. The estimated cost to the respondents to complete CF 1303 is $567,840.00, based on an estimated 26,000 burden hours at an hourly rate of $21.84.


13. Estimated Recordkeeping Burden on the Public. There is no recordkeeping burden associated with this information collection.


Estimated Capitalization Burden on the Public. There is no capitalization cost associated with this information collection.


14. Estimated Cost to the Federal Government. The estimated cost to the Government associated with collecting, analyzing, and processing information collected by CBP Form 1303 is $1,284,850. This is based on 36,710 hours expended at an average hourly rate of $35.00.


15. There are no changes to this information collection.


16. This information collection will not be published for statistical purposes.


17. The expiration date is displayed on this form.


18. CBP does not request an exception to the certification of this information collection. See attached Item 19 of Form OMB 83-I.
