The information collection is used to record an alien's application for a waiver of the nonimmigrant visa requirement for entry into Guam. This collection is being expanded, in accordance with Public Law 110-229, to include aliens seeking entry into the Commonwealth of the Northern Mariana Islands.
Public Law 110-229 requires that the Guam Visa Waiver Program which is currently administered by CBP be expanded to include the Commonwealth of the Northern Mariana Islands. This law requires that CBP publish regulations by November 4, 2008. CBP plans to publish an IFR.

The burden hours were increased by 29,880 hours as a result of the new statutory mandate to expand this collection to include aliens seeking entry into the Commonwealth of Northern Mariana Islands (CNMI). The burden hours were also increased by an additional 85,490 hours to correct CBP’s previous underestimate of the original collection which applied only to Guam Visa Waivers. CBP had previously reported that only 170,000 respondents applying for Guam Visa Waivers, when there are actually 1,200,000 respondents applying.
