These regulations allow a 401(k) plan using the safe harbor provisions of section 401(k)(12) to suspend or reduce nonelective safeharbor contributions due to a business hardship. They must give employees notice of this reduction.

These regulations affect administrators of, employers maintaining, participants in, and beneficiaries of certain section 401(k) plans and section 403(b) plans. The collection of information in these proposed regulations is in §1.401(k)-3. The collection relates to the new supplemental notice in the case of a reduction or suspension of safe harbor nonelective contributions. The change in these regulations has increased the burden by 10,000 hours.
