A. Justification


1. The provisions of 19 CFR 19.8 allow, for application by an importer, on CBP Form 3499, "Application and Approval to Manipulate, Examine, Sample or Transfer Goods", to examine, sample, repack or transfer merchandise under Customs and Border Protection (CBP) supervision. The application is approved by the port director, if it does not interfere with the orderly conduct of CBP business and presents no threat to the revenue. 19 CFR 19.11 provide for the use of CBP Form 3499 as a request for manipulation of merchandise (cleaning, repacking, sorting, etc.) in a bonded warehouse, upon approval by the port director. Application for abandonment or destruction of merchandise in bond shall be made on Form 3499 under 19 CFR 158.43(a).


2. CBP Form 3499 is used as an application to perform various operations on in-bond merchandise while under CBP supervision. The applications for such procedures are made by importers, consignees, transferees or owners of the merchandise involved and is subject to approval by the port director. The data requested on the form identifies the merchandise for which action is being sought and specifies in detail what operation is to be performed. This information enables the port director to determine whether or not approval of the application would pose a threat to the revenue and/or interfere with the normal course of CBP business. The form may also be approved by the port director as a blanket application to manipulate for a period of up to 1 year, for a continuous or repetitive manipulation. The warehouse proprietor must maintain a running record of the manipulations performed under the blanket application showing the pertinent information the same as if it was a one-time manipulation.


3. This form will be automated as part of the Automated Commercial Environment (ACE). This automation is planned for 2013.


4. The information on CF 3499 is collected only on this form for specific operations and is not duplicated elsewhere.


5. This information collection will not have a significant impact on a substantial number of small businesses.

6. If this information were collected less frequently, it would pose a threat to the revenue and interfere with the normal course of Customs business.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.6.

8. Public comments were solicited through two Federal Register notices dated March 16, 2009 (Volume 74, Page 11124-11125) and on May 27, 2009 (Volume 74, Page 25272). No comments were received.


9. There is no offer of a monetary or material value for this information collection.


10. There are no specific assurances of confidentiality provided with this information collection.


11. There are no questions of a personal and sensitive nature.
