1. Each person, business firm, Government agency or other organization shall file Form 5106, Notification of Importer's Number or Application for Importer’s Number, or Notice of Change of Name or Address as set forth in 19 CFR 24.5 of the Customs and Border Protection (CBP) Regulations. This shall be filed with the first formal entry or the first request for services that will result in the issuance of a bill or a refund check upon adjustment of a cash collection. A Form 5106 shall also be filed for the ultimate consignee for which such entry is being made.


2. Form 5106 will be completed by the trade or by CBP personnel. The number, name, and address conveyed on the Form 5106 is the basis for establishing bond coverage, release and entry of merchandise, liquidation, issuance of bills and refunds, and processing of drawback and FP&F actions.


3. This information can be transmitted electronically via the Automated Broker Interface system.


4. The information on Form 5106 is unique and is, therefore, not duplicated elsewhere.


5. This information collection does not have an impact on small businesses or other small entities.


6. If the collection of this information were conducted less frequently CBP would be unable to establish accurate records for establishing bond coverage, release and entry of merchandise, liquidation, issuance of bills and refunds, and processing of drawback and FP&F actions.


7. This information collection is conducted in a manner consistent with the guidelines in 5 CFR 1320.5(c)(2).


8. Public comments were solicited through two Federal Register notices dated, April 9, 2009 (Volume 74, Page 16226) and on July 7, 2009 (Volume 74, Page 32175). No comments were received.


9. There is no offer of a monetary or material value for this information collection.


10. No specific assurances of confidentiality are provided with this information collection.


11. There are no questions of a personal or sensitive nature.

The estimated cost to the respondents is $28,000. This is based on the estimated burden hours (1,000) multiplied (x) the estimated average hourly rate ($28.00).


13. Estimated Record Keeping Burden on the Public. There are no record keeping, capitalization, start-up or maintenance costs associated with this information collection.


14. Estimated Cost to the Federal Government


The annual estimated cost to the Federal Government associated with reviewing and processing the information is $2,905. This is based on the time spent per response (5 minutes or .083 hours) x number of responses (1,000) = 83 hours expended x an annual rate of $35.00 = $2,905.

15. There has been no increase or decrease in the estimated annual burden hours previously reported for this information collection.
