Exportation of Used Self-Propelled Vehicles

Explain the circumstances that make the collection of information necessary. Identify any legal or administrative requirements that necessitate the collection. Attach a copy of the appropriate section of each statue and regulation mandating or authorizing the collection of information.
19 U.S.C. 1627 requires the exporter of a used self-propelled vehicle to present both the vehicle and a document describing it (which includes the vehicle identification number) before lading if the vehicle is to be transported by vessel or aircraft, or before export if the vehicle is transported by rail, highway, or under its own power. The statute provides for a $500 civil penalty for failure to comply. This requirement is provided for in 19 CFR 192.2.
2. Indicate how, by whom, and for what purpose the information is to be used. Except for a new collection, indicate the actual use the agency has made of the information received from the current collection.
The CBP regulations require an individual attempting to export a vehicle to furnish documentation, to include the VIN (vehicle identification number), sufficient to prove to Customs and Border Protection (CBP) that the vehicle is lawfully owned by the exporter. CBP will accept originals or certified copies of Certificate of Title. The exporter must also present two facsimiles of the original document or certified copy. If the documents are not submitted, CBP could not fulfill its regulatory requirements to verify ownership. The purpose of this program is to help CBP ensure that stolen vehicles are not exported.

Describe whether, and to what extent, the collection of information involves the use of automated, electronic, mechanical, or other technological collection techniques or other forms of information technology, e.g. permitting electronic submission of responses, and the basis for the decision for adopting this means of collection. Also describe any consideration of using information technology to reduce burden.
This process cannot be automated because CBP is required to perform a physical inspection of the original documents (certificate of ownership, title, etc) or certified copy to verify that the individual exporting the vehicle has legal ownership.
4. Describe efforts to identify duplication. Show specifically why any similar information already available cannot be used or modified for use for the purposes described in Item 2 above.

Requiring this information in advance of export helps CBP ensure that stolen vehicles are not exported. Once a stolen vehicle leaves the U.S. it is almost impossible to recover. This information collection is required under 19 U.S.C. 1627a.

This information is collected in a manner consistent with the guidelines of 5 CFR 1320.5(d)(2).
If applicable, provide a copy and identify the date and page number of publication in the Federal Register of the agency's notice, required by 5 CFR 1320.8(d), soliciting comments on the information collection prior to submission to OMB. Summarize public comments received in response to that notice and describe actions taken by the agency in response to these comments. Specifically address comments received on cost and hour burden.
Public comments were solicited through two Federal Register notices published on April 9, 2009 (Volume 74, Page 16227) and on August 4, 2009 (Volume 74, Page 38663). No comments were received.

There is no offer of a monetary or material value for this information collection.

Public Cost
The estimated cost to the respondents is $3,500,000. This is based on the estimated burden hours (125,000) multiplied (x) hourly rate ($28.00).

The estimated annual cost to the Federal Government associated with the review of these records is $4,357,500. This is based on the number of responses (750,000) that must be reviewed multiplied (x) by the time to review and process each response (.166 hours) = 124,500 hours multiplied (x) by the average hourly rate ($35.00)= $4,357,500.

There has been no increase or decrease in the estimated annual burden hours previously reported for this information collection.
