In 2006 HUD (FHEO) revised form HUD-935.2 Affirmative Fair Housing Marketing (AFHM) Plan. This revision
consists of creating:
a. Form HUD-935.2A “Affirmative Fair Housing Marketing (AFHM) Plan-Multifamily Housing” to be used
by multifamily housing developers.
b. Form HUD-935.2B “Affirmative Fair Housing Marketing (AFHM) Plan-Single Family Housing” to be used
by single family housing developers.
This action was taken to make the completion of the form clearer for the multifamily housing and single family housing
user. The form HUD-935.2 had several instances where there were alternative directions for multifamily housing and single
family housing users which made the form confusing. .
After the form were separated, it was brought to our attention that the two new forms did not cover condominiums/
cooperatives. In order to remedy this problem HUD thought it would be better to create a new form for
condominiums/cooperatives to keep the completion of this form clearer for the user. When HUD did the Paperwork
Reduction Act Submission in 2006, the burden hours for condominiums/cooperatives were included in the burdens
hours for single-family housing. Attached is the new form:
HUD-935.2C “Affirmative Fair Housing Marketing (AFHM) Plan- Condominiums/Cooperatives” to be used by
condominium/cooperative developers.
In the 2006 Paperwork Reduction Act Submission –Justification Item 12. AFHM Plan-Single Family Housing-
HUD-935.2B: HUD estimated that approximately 30 new single family housing projects (this includes
condominiums/cooperatives) would submit the HUD-935.2B, because most of the builders would take advantage
of the exemption and use the option on form HUD-92541-Builder’s Certification of Plans, Specifications, & Site-
Block 11, to self certify compliance with HUD’s Affirmative Fair Housing Marketing Regulations.
With the new form HUD 935.2C condominium/cooperative developers (included in the 30 new single family housing
projects) may now submit the HUD-935.2C. The builders will be able to determine if they need to complete the
HUD-935.2C or if they can self certify compliance with HUD’s Affirmative Fair Housing Marketing Regulations by
completing Questions 1and 2 in the “Applicability” Section of the form. Most of the builders will take advantage of the
exemption and self certify.
