This request to
change an existing information collection is disapproved. EPA has
requested to add a number of forms that would be used in the
designation of additional source categories as Energy Star.
However EPA has not demonstrated that the collection of information
would be subject to sufficiently robust program integrity
improvements and analytical methods to ensure that this information
will have practical utility consistent with the 5 CFR 1320. OMB
recommends that the Agency consider revising and resubmitting the
information collection request after completing planned initiatives
to improve Energy Star program integrity, and that the resubmitted
request be consistent with EPA and OMB guidance; we would be happy
to work closely with EPA to facilitate this resubmission. The
previous terms of clearance continue to apply.

In order to ensure continued success
and benefits to ENERGY STAR Program Partners, protect the integrity
of the ENERGY STAR label, and enhance its effectiveness in the
marketplace, EPA must ensure that products carrying the label and
the manufacturers that are labeling them as ENERGY STAR meet
appropriate program requirements. EPA asks for the following
program information from ENERGY STAR product manufacturing
Partners: 1) sign a Partnership Agreement supplying company contact
information; 2) submit qualifying product information that EPA can,
in turn, provide to consumers so they will know which products to
purchase in order to save energy; 3) submit testing reports (for
roof products and lighting only) to verify product qualification;
4) submit annual unit shipment data to ensure the program provides
continued benefits to Partners; and 5) submit an application for a
Partner of the Year Award, if Partner wishes to receive recognition
for their efforts.
On behalf of this Federal agency, I certify that

1320.8(b)(3).
