The agency discretion increase in burden is due to a change in the regulations. Pursuant to 29 CFR 570.2(b), a change is proposed to conform to the existing provisions requiring "written consent" from a parent or person standing in the place of a parent allowing a minor age 12 or 13 years to perform non-hazardous work in agriculture outside of school hours. The proposed regulations make it a requirement for minors under age 12 years to also have written parental consent to perform non-hazardous work in agriculture outside of school hours. The existing regulation only requires "consent." The proposed regulation will require "written consent" for persons under age 12.
