PROPOSED RULE for 10 CFR Part 73, Enhanced Weapons, Firearms Background Checks, and Security Event Notifications The NRC is proposing to amend the current security regulations and add new security requirements pertaining to nuclear power reactors and Category I SSNM facilities for access to enhanced weapons and firearms background checks. The proposed rulemaking would fulfill certain provisions of the Energy Policy Act of 2005 and add several new requirements to event notification requirements that resulted from insights from implementation of the security orders, review of site security plans, and implementation of the enhanced baseline inspection program and force-on-force exercises. NOTE: Burden hours for this proposed rule have been entered under clearance numbers 3150-0204 (NRC Form 754) and 3150-0002 (10 CFR Part 73). ALL Federal Government costs for the rule have been entered under 3150-0002, Part 73.

The NRC is proposing regulations that would implement its authority under the new section 161A of the Atomic Energy Act of 1954 (AEA), as amended, and revise existing regulations governing security event notifications. These proposed regulations are consistent with the provisions of the Firearms Guidelines the NRC published under section 161A with the approval of the U.S. Attorney General on September 11, 2009 (74 FR 46800). Changes include allowing licensees to apply for stand-alone preemption authority or combined enhanced weapons authority and preemption authority, and requiring licensees who apply for enhanced weapons authority to submit revised security plans and safety assessments and keep records of weapon inventories. Hours and responses associated with these changes are included in 73.18 and 73.19 and are reported as due to new statute. In addition, the proposed rule expands the applicability of security event notification requirements to additional facilities and activities. These information collections appear in 73.71. Burden hour changes associated with security event notifications are reported as a change due to agency discretion.
