The U.S. Department of Education (the Department) is requesting approval to revise the TEACH Grant Agreement to Serve (ATS) (OMB No. 1845-0083) to reflect changes to the Higher Education Act (HEA) that were made by the Higher Education Opportunity Act (HEOA; Public Law 110-315) and final regulations published on October 29, 2009 (74 FR 55902) implementing those statutory amendments, and to make minor conforming changes. These changes are as follows:

(1) New provision for discharge of the TEACH Grant service obligation based on military service pursuant to HEA 420N(d)(2) and 34 CFR 686.41-42;

(2) Expansion of qualifying employment to include teaching in an educational service agency pursuant to HEA 420N(b)(1)(B) and 465(a)(2)(A);

(3) New requirements related to teaching in certain high-need fields pursuant to HEA 420N(d)(1);

(4) Replacement of all references to the “Direct Loan Servicing Center” with “your servicer,” to reflect the fact that there is no longer a single servicer for all Direct Loan Program loans; and

(5) Revised description of the Income-Based Repayment (IBR) Plan that (a) eliminates a reference to a July 1, 2009 effective date that is no longer needed, and (b) uses language that is more consistent with the IBR Plan regulations. The language describing the IBR Plan in the current ATS was developed prior to the effective date for the IBR Plan, and prior to the IBR Plan final regulations (73 FR 63232).

Changes (1) through (3) are needed to reflect statutory amendments to the terms and conditions of TEACH Grants and, in the case of (1), regulatory changes that were developed through the negotiated rulemaking process. It is important for TEACH Grant recipients to be informed of these changes at the time they complete the ATS. Changes (4) and (5) are conforming changes.

The proposed changes do not affect the burden associated with this collection. The new provision described in (1) will require TEACH Grant recipients to provide certain documentation to support a request for discharge of the service obligation. Any burden associated with this requirement does not affect the current collection and will be reported in connection with a future military discharge request form that will be submitted for clearance. While change (2) expands the scope of permissible employment for purposes of satisfying the TEACH Grant service obligation to include educational service agencies as well as traditional schools, this will not result in an increase in the number of individuals who complete the ATS. Students are unlikely to plan years in advance to work for an educational service agency as opposed to a traditional school.
