The information will be used by EPA or a delegate tribal agency assisting EPA with administration of the rules, until replaced by an EPA-approved implementation plan, to: (1) identify new or modified major and minor sources subject to the NSR rules, (2) ensure that control technology, if required, is being properly applied, and (3) ensure that the emission control devices are being properly operated and maintained on a continuous basis. Potential respondents are owners or operators of all new minor stationary sources and minor modifications (to both minor and major sources) in Indian Country, and those new major stationary sources and major modifications located in portions of Indian Country that are in nonattainment areas.

EPA is establishing nationally applicable regulations to implement a permitting program in Indian country, which will regulate the construction and modification of stationary sources of air pollution and allow certain new and existing stationary sources to voluntarily accept federally enforceable emission limits in order to avoid major source regulations. These regulations affect new and modified minor stationary sources and minor modifications at existing major sources in Indian country and also regulate new major sources and major modifications in portions of Indian country that are not in attainment of the National Ambient Air Quality Standards (NAAQS), i.e., nonattainment areas.
