Abstract: Section 724(a) of the Dodd-Frank Act imposes legal requirements for the protection of collateral provided by cleared swaps customers to margin, guaranty, or secure their market positions. The CFTC's proposed new Part 22 rules implement these requirements. Certain of the proposed rules require calculation, retention, and/or disclosure of information regarding customer positions, collateral, and the legal terms on which collateral is held.
