Manufacturers of Ammunition, Records and Supporting Data of Ammunition Manufactured and Disposed of
Justification
Manufacturer’s records of ammunition apply only to disposition of armor piercing ammunition (required by 18 U.S.C. 922 (b) (5)). Manufacturers of armor piercing ammunitions must keep records of armor piercing ammunition manufactured and the disposition of that ammunition. This record is primarily for law enforcement purposes. Ammunition may be traced by the use of these records. This evidence may serve to assist in a criminal investigation or court presentation. These records may also be used in compliance inspections to determine the validity of the record keeping system by comparing raw material used with the finished product on hand plus the quantity sold to customers. The manufacturer’s commercial records in most instances, contains the data elements specified in the regulations.
Records are established by licensees by entering the required information into the proper record book as required by 27 CFR 478.123(b) and 125(d). Records are used by licensees for accounting and excise tax purposes. ATF uses the information during investigations or inspections for criminal or compliance purposes.
ATF has approved and will continue to approve, on a case by case basis, the use of improved information technology for the maintenance of required records. The required information is recorded in a bound record at the time a transaction is made. Pursuant to ATF Ruling 2008-2, a manufacturer may maintain the required records in electronic format. Additionally, pursuant to ATF Ruling 2010-8, the manufacturer may consolidate all required records.
ATF uses a uniform subject classification system to identify duplication and to ensure that any similar information already available cannot be used or modified for use for the purpose of this information collection.
The collection of this information would have no impact on small businesses or other small entities.
Less frequent collection of this information would pose a threat to public safety.
This information requirement is conducted in a manner consistent with 5 CFR 1320.6.
The ATF industry liaison consulted with the firearms industry during the creation
of this collection. The 60-day and 30-day public comment notices was published in the Federal Register in order to solicit comments from the general public. No comments were received.
No payment or gift is associated with this information collection.
These records are maintained at the premises of the licensee. Confidentiality is
not assured.
11. Respondents are not required to keep records of a sensitive nature.
12. The number of respondents (Type 10 FFL’s) associated with this collection is
260. Each respondent will respond one time occasionally. The total number of responses is 260. It is estimated to take 30 minutes per respondent to respond. The total annual burden for this information collection is 130 hours (260 respondents x 30 minutes divided by 60). The record retention requirement for this information collection is 2 years.
13. There is no startup or annual cost to the respondent.
14. There is no cost to the Federal Government.
15. The number of responses decreased from 325 to 260 based on the current
estimated number of licensed Manufacturers of Destructive Devices, Ammunition for Destructive Devices or Armor Piercing Ammunition. The burden hours are reduced from 325 hours to 130 hours due to the decreased number of responses. The respondents only have a recordkeeping requirement, therefore, the reporting requirement along with the reporting burden hours are eliminated.
16. The results of this collection will not be published.
17. ATF does not request approval to not display the expiration date for OMB
approval of the information for this collection.
18. There are no exceptions to the certification statement.
