The Commission is authorized by IGRA to issue certificates of self-regulation to tribes for Class II gaming operations. This information collection requirement is necessary to determine whether a tribe meets the requirements for self-regulation. In addition, those tribes who have received a certificate of self-regulation are required to submit certain information to the NIGC to establish that the tribe continuous to meet the criteria to self-regulate.

Changing Regulations
The Commission recently amended part 518 with the revised regulations effective as of September 1, 2013. While the revised regulations should lessen the hourly and cost burden estimates because: (i) the Commission is no longer requiring the submission of certain information that is already collected under other OMB control numbers, such as gaming ordinances and facility licenses; (ii) the Commission is limiting the submission of resumes to those of TRB employees; and (iii) tribes are no longer required to submit annual statements on the usage of their net gaming revenues, the overall burden hour and cost estimates increased because Commission expects that the revised regulations will cause other tribes to petition the Commission for certificates of self-regulation, at a rate of two additional tribes per year. The majority of the increase in burden hours and costs are the result of the new tribes that will be submitting petitions to the Commission.
