This collection of information is
required by the Trademark Act, 15 U.S.C. et seq., and is
implemented through the Trademark rules set forth in 37 CFR Part 2.
Individuals and businesses that use, or intend to use, such marks
in commerce may file an application to register their marks with
the USPTO. They can also submit various communications concerning
their pending applications or registered trademarks. In the
majority of cases, individuals and businesses retain attorneys to
handle these matters. This collection provides for the various
activities related to the appointment and retention of attorneys of
record or domestic representatives. The information in this
collection can be submitted in paper format or electronically
through the Trademark Electronic Application System (TEAS). In
addition to the original TEAS forms, the USPTO has a TEAS Global
Form format that permits the agency to collect information
electronically when a TEAS form with dedicated data fields is not
available.
The USPTO has concluded, with
agreement from OMB , that change of address forms are exempt from
the PRA under section 5 CRF 1320.3. Therefore USPTO is removing
both the change of owner's and the change of domestic
representative's address forms filed both through paper and TEAS
from this collection, as address changes are considered exempt from
the paperwork reduction act provisions.
