As part of the administration of its
programs, U.S. Citizenship and Immigration Services (USCIS)
exercises its prosecutorial discretion on a case by case basis to
defer action on instituting removal proceedings against
individuals.
US Code:
8 USC
1103 Name of Law: Powers and duties of the Secretary, the Under
Secretary, and the Attorney General
The annual burden hours
reported during the last submission to OMB have decreased. This is
as a result of a decline in the number of DACA initial and renewal
filings within the current reporting period. In the 2014 revision,
USCIS reported 244,602 for initial DACA requests and 350,000 for
renewals. USCIS is now reporting 58,314 for initials and 200,306
for renewals. DACA runs on a frontloaded two year cycle. When USCIS
began accepting DACA requests, there was a surge in initial
filings. The filings steadily decreased over the following months.
Two years later, another spike in DACA filings occurred; however
the numbers were not as high as originally estimated.
