The Office of Surface Mining Reclamation and Enforcement (âweâ or OSMRE) is submitting this request to revise its information collection authority for 30 CFR part 780. This regulation governs the minimum requirements for preparing Reclamation and Operation Plans to be submitted as part of a surface mining permit application package.
OSMRE proposed a Stream Protection Rule (SPR) on July 27, 2015, (80 FR 44436) which proposed to modify the collection requirements in 30 CFR part 780. This proposed rule sought comments from the public comments on the burden estimates we identified, the availability of data, frequency of collection, the clarity of instructions and recordkeeping, disclosure, or reporting format, and on the data elements to be recorded, disclosed, and reported for the entire part associated with the information collections approved by the Office of Management and Budget (OMB) under 1029-0036.
OMB assigned control number 1029-0133 to this collection, but reserved approval pending review of the information collection package associated with the final SPR.
OSMRE received over 94,000 comments on the proposed rule, many of which had information collection ramifications. These comments were reviewed and the final SPR has incorporated changes, where appropriate, to reflect the comments. Likewise, this information collection request has been modified from the original request to OMB to incorporate those final rule changes and the public comments which affect this information collection request.
OSMRE is now submitting this information collection package based on the SPR which modifies the collection requirements in 30 CFR part 780. The final rule and information collection packages associated with this rule incorporate comments received from the public on the burden estimates for part 780, the availability of data, frequency of collection, the clarity of instructions and recordkeeping, disclosure, or reporting format, and on the data elements to be recorded, disclosed, and reported.
This information collection request will increase the burden estimate for part 780 on respondents by 28,669 hours and $6,444,960 in non-wage costs due to program changes resulting from publication of the Stream Protection final rule. This information collection request also re-estimates burden due to adjustments of 149 hours for a new total of 84,323 hours and $7,474,551.
