is approved for 3 years. EEOC and OMB have come to an agreement on
a phased approach for EEOC to come into compliance with OMB’s Race
and Ethnicity Standards. As part of this agreement, EEOC should
report to OMB at the completion of each phase on the progress the
agency has made and to discuss next steps with OMB before
proceeding to the next phase.

EEOC regulations require State and
Local Governments with 100 or more employees to collect and retain
in their records demographic information about their employees, and
report this information to EEOC biennially in odd-numbered years.
EEOC uses this information to evaluate and prioritize charges under
the Commission’s charge processing system and to determine the
appropriate investigative approaches. The data can be analyzed to
develop statistical evidence as the investigation proceeds. EEOC
also uses the data to develop ad hoc studies of the public sector
work force. The data are shared with the Department of Justice.
Pursuant to §709(d) of Title VII, EEO-4 data are also shared with
State and Local Fair Employment Practices Agencies (FEPAs) for
their enforcement efforts. The data are also used by researchers
who request it for use in academic studies.
