This is a new information collection request (ICR) associated with the publication of a Final Rule. In accordance with the Paperwork Reduction Act, an ICR was submitted to the Office of Management and Budget at the Notice of Proposed Rulemaking stage. OMB filed comment on the proposed rule on January 19, 2016 and assigned OMB control number 2132-0578 "Public Transportation Safety Certification Training Program (PTSCTP)". This is a mandatory information collection. The Moving Ahead for Progress in the 21st Century Act (MAP-21) authorized the Federal Transit Administration (FTA) to provide a framework to enhance the technical proficiency of those directly responsible for safety oversight of public transportation systems. The information collected allows the FTA to record completion of the required training and to ensure annual certification. The program respondents are Rail Transit Agencies and State Safety Oversight Agencies who will forward information to FTA on behalf of designated personnel, who conduct safety audits and examinations of public transportation systems, and employees of public transportation agencies directly responsible for safety oversight. This requirement is necessary to assure that compliance with the requirements is properly and earnestly undertaken by recipients who are statutorily required to implement safety training to increase the technical and professional competence of those who directly responsible for safety oversight of public transportation systems. To comply with 49 U.S.C. § 5329(c)(1), designated personnel are required to register electronically for the PTSCTP and request an individual training plan (ITP). FTA then issues an ITP with a curriculum associated with his or her job category. Following registration, participants enroll in courses specific to their curriculum. FTA will maintain an electronic record of all training completed.

This ICR associated with the Final Rule reflects no change from the NPRM to the Final Rule publication. FTA inadvertently uploaded the wrong number of responses and respondents in the ROCIS system at the NPRM stage. However, the supporting statement and final rule had the correct data. Again, there is no change in burden from the NPRM to the Final Rule publication associated with this ICR.
