For future submissions of this information collection, reference the OMB Control Number provided. Pursuant to 5 CFR 1320.11(c), OMB files this comment on this information collection request (ICR). The agency shall examine public comment in response to the NPRM and will describe in the supporting statement of its next collection any public comments received regarding the collection as well as why (or why it did not) incorporate the commenter’s recommendation. In addition, the agency shall incorporate into the final submission supporting statement a detailed discussion of the ICR burdens, including tables showing the marginal differences between the proposed and final rules, and aggregate burden estimates for all activities accounted for in the package. The next submission to OMB must include the draft final rule.

The Commission proposed new information collection related specifically to the Commission’s proposed changes to Part 39 of its regulations to establish a regulatory framework for exempt derivatives clearing organizations (“DCOs”), pursuant to Section 5b(h) of the CEA (7 U.S.C. 7a-1(h)). Although Part 45 applies to a number of registered entities and market participants, including registered DCOs, the proposed changes would affect only the reporting burden for exempt DCOs. Exempt DCOs’ clearing of swaps will be limited to proprietary positions of U.S. persons that are clearing members or affiliates of clearing members of that clearing organization. The information collection is necessary to fulfill the Commission’s statutory and regulatory mandates, including systemic risk mitigation, market monitoring, and market abuse prevention. The information is used to provide oversight and supervision and to ensure compliance with statutes and regulations relating to swaps.
