Abstract: The American Fisheries Act of 1998 (AFA), Title II, Division C, Public Law 105-277, requires that fishing industry vessels of 100 feet or greater in registered length must be owned and controlled by citizens of the United States within the meaning of 46 U.S.C. 50501. To comply with this requirement, MarAd’s Office of Chief Counsel, Division of Maritime Programs collects citizenship information through the use of an affidavit of U.S. citizenship for vessel owners, preferred mortgagees, mortgage trustees, and charterers. This information is required to obtain or retain benefits.
