Under the Internal Revenue Code (IRC)
at 26 U.S.C. 5005(c), when a proprietor of a distilled spirits
plant (DSP) or an alcohol fuel plant (AFP, a type of DSP) desires
to have spirits or denatured spirits transferred to its plant from
another domestic plant, the proprietor must make an application to
receive such spirits in bond. Under that IRC authority, the TTB
regulations in 27 CFR part 19 require the receiving proprietor to
file an application for the transfer on TTB F 5100.16, Application
for Transfer of Spirits and/or Denatured Spirits in Bond. TTB must
approve the application before the transfer may occur. The
collected information is necessary to protect the revenue as it
allows TTB to ensure that the receiving plant has adequate bond
coverage or, for certain small alcohol excise taxpayers, is exempt
from such bond coverage.
