In response to the emergency request memorandum submitted by the SEC on 11/15/2022, OIRA is approving the Commission's request for emergency approval of this OMB control number for a period of six months. This action is necessary to reinstate this OMB control number. Prior to the expiration of this package in six months, SEC shall undertake standard PRA notice and comment procedures.

Rule 19b-5 permits a self-regulatory organization (SRO) to operate a pilot trading system, under certain conditions, for two years without submitting a proposed rule change to the Commission pursuant to Rule 19b-4. SROs availing themselves of Rule 19b-5 are required to file a Form PILOT at least 20 days before com- mencing operation of the system. SROs are also required to file notices of material systems changes and quarterly activity re- ports on Form PILOT.
The SEC’s Internal Sharepoint System that they use to track and process all of their PRA’s failed resulting in the 30 and 60 Day Notices not being sent to the Federal Register for timely Publishing, therefore the ICR Expiration Date was missed. The estimated burden hours decreased by a factor of three from 126 hours to 42 hours. Based on recent experience, the SEC has reduced its estimate of the number of respondents from three (3) per year to one (1) per year, resulting in a proportionate uniform reduction in the burden hours. The estimated costs decreased by $6,670 from $10,670 to $4,000. The decrease is due to the reduction in the estimated number of respondents from three (3) to one (1). The costs did not decrease by a full factor of three however because of an increase in the per respondent cost estimates due to inflation.
