For projects funded under Title 23, United States Code, FRA complies with the Federal Highway Administration’s pre-award authority requirement in 23 CFR 1.9

Certification of Project Sponsor POC
In accordance with 2 CFR §200.458, pre-award costs are those incurred prior to the effective date of the federal
award directly pursuant to the negotiation and in anticipation of the Federal award where such costs are necessary
for efficient and timely performance of the scope of work. Such costs are allowable only to the extent that they would
have been allowable if incurred after the date of the Federal award and only with the written approval of the Federal
awarding agency. The costs must appear in the grant agreement scope of work to be eligible for reimbursement after
the grant is awarded. Furthermore, the type and timing of costs incurred must be consistent with 23 CFR § 771.113.
understands that pre-award costs are considered at-risk until the grant agreement has been
executed, and FRA will authorize such pre-award costs only to the extent they are allowable under the terms of the
grant agreement.
also assures FRA that all materials purchased before NEPA approval are items that can
be reused or sold, and that the project will not proceed to Final Design prior to the completion of NEPA. Finally, the
understands that Construction work may not begin until FRA has reviewed and approved all required design
documentation.
All pre-award costs are incurred at
's risk. The Federal awarding agency, FRA, is under no obligation to
reimburse such cost if for any reason
