In the final rule, the Patient Protection and Affordable Care Act; HHS Notice of Benefit and Payment Parameters for 2017 (CMS-9937-F), we finalized 45 CFR 156.1256, which requires QHP issuers, in the case of a material plan or benefit display error included in 45 CFR 155.420(d)(12), to notify their enrollees of the error and the enrolleesâ eligibility for a special enrollment period within 30 calendar days after the issuer is informed by an Federally- facilitated Exchange (FFE) that the error is corrected, if directed to do so by the FFE. This requirement provides notification to QHP enrollees of errors that may have impacted their QHP selection and enrollment and any associated monthly or annual costs, as well as the availability of a special enrollment period under §155.420(d)(12) for the enrollee to select a different QHP, if desired.

There is an overall decrease in burden because of a relatively stable number of issuers and a decrease in the number of enrollees receiving notices. The number of QHP issuers increased from 374 to 394 and is expected to continue trending down in future years. The number of issuers is derived from the average number of individual QHP, SADP, and dual issuers on the FFE between plan years 2023 and 2025. The number of enrollees receiving notices decreased from 58,461 to 30,527 enrollees, which is a decrease of 27,934 enrollees. The number of enrollees is derived from the average number of enrollees that received notices in plan years 2023 through 2025. This number excludes those notices issued in plan year 2023 related to a plan marketing name issue that generated a large number of notices (an outlier) that will not recur because of subsequent regulatory changes targeted at that specific issue. The total annual burden hours decreased from 292.50 hours to 152.50 hours, which is a decrease of 140 hours.
